Inhalt:
E-Business is a very wide area, so multitudes of different legal questions occur. As the Internet as well as company-internal computers and the network connections to the outside are indispensable tools of modern business, these issues must be considered. Aim of the course is to introduce the students to the most important of the legal areas connected to doing business online with a focus on E-Commerce. In some cases, more in-depths information is provided, while for others only the general problems will be described. The overall goal is that students can later identify the need for specialist advice when encountering specific issues.
The topics are described based on Austrian and EU law and in some cases specific international laws or rules. The areas covered are:
  • Copyright: Works, the protection of computer programs, database protection
  • Domain names: Protection of domain names (competition-, name-, trademark-, copyright law, …), Domain grabbing/RDNHJ, rules for dispute resolution (UDRP)
  • "Website law": Information requirements, copyright protection, liability of providers, legal regulations of links and embedded elements
  • Advertising: Meta-Tagging, Word-Stuffing, Adwords, Pop-ups, E-Mail advertisements, Banners
  • Privacy: Normal vs. sensible data, exceptions, subject rights, international data exchange, data protection register
  • Software patents: What are patents, what is the special problem of software patents, what can be patented

Beurteilung:
Die Note setzt sich aus folgenden Elementen zusammen:
  • Schriftliche Prüfung am Semesterende (90%)
  • Mitarbeit, insbesondere in der Übung und den Fernunterrichtsteilen (10%)

Anwesenheitserfordernis: 75%

Die Prüfungen richten sich nach den in der Vorlesung vorgetragenen und den Übungen bearbeiteten Teilen und nicht dem Buch, welches vielfach zusätzliche Informationen enthält!
